Good catch Gareth Davies and 4th Gordons. You have solved the mystery, The Transvaal Scottish!

Ron Marsden is a highly respected contributor to the Black Watch Forum: "Badge worn on the kahki Tam-o-shanter during 1938 until the arrival of the 'Red Hackles' on 1st July 1938," So, this says that the photo is 1938 or later as is consistent with earlier opinions on the dating.

Also, I did find a family tree for John Underwood Nicol. This indicates that he died in 1946 but with no further details. This would make Nicol 60 at the time of his death which is also plausible.
