Posting images from sites like British Newspaper Archive

Images created by members from their own copies of publications that are out of copyright are in no way restricted. 

 

We consider that companies that have created fresh images of a publication  such as The Tatler for commercial purpose are at the least able to assert copyright in those images. We do not propose to challenge that. 

 

The BNA permits some sharing, properly sourced of images, and we accept that this is permissible under “Fair dealing” . 

 

If that is so, then UK government advice on Fair Dealing applies. This is from a current UK official publication.

If any member chose to publish the great majority of the relevant images now available from the Tatler we consider that we would not be compliant with the “Fair Dealing” policy. 

 

We cannot define a reasonable number, but expect members to respect the advice, and will, when we must, consider images from the BNA against a test, firstly of an appropriate reference, and of a sensible approach to considering the second factor above: 

 

Is the amount of work taken reasonable and appropriate? 

 

Was it necessary to use the amount that was taken? 

 

Usually only part of a work may be used. 

 

If you feel the image passes these criteria, then you also need to include not just general information such as the publication name, date and page but you must also include the following copyright citation:
