George Evans Contributor on Find A Grave

Hi

I am just after some advice after finding 2 personal photographs of my relatives

on the above web site and grave photographs to George Sibley and Sidney A Eady

accredited to George Evans CWGC/ABMC (#6)

He has • 723,104 Memorials Added

• 673,287 Memorials Managed

• 1,069 Memorials/week

As these photo are in the public domain does that mean anyone can take a copy

of them and put on another web site without permission of the owner.

I wondered if anyone else has had the same experience.

Really upset as I was going to do a web site of my Soldiers and realise that

other photos may also appear without my consent.

Mrs Roxy is a pro photographer; I'll ask her about copyright law tonight. I think that, nowadays, the file will tell you what camera tok the photo, so the individual will not be able to suggest that it is his photograph; it just looks very similar to yours!

The picture of George looks like it is definitely yours, Sandy (i.e. it has the poppy "watermark" on it). I think the picture of the grave has been photographed and added by a local photographer - i.e. it wasn't the exact same one you have.

The photo is more than likely the one another GWF member got me years ago and I lost it, hence your kind

offer recently.

The one of Sidney is a think one I have from the British War Graves so not the same.

Therefore is that where this person is collecting them all from, here.

I have spent the whole week-end gathering information together for my web site but now

do not think I will try to do it, besides doing a excel file for another GWF member on the

TNA War Diaries.

Well, well amazing.

Photo of my Uncle George has been removed after sending them this link.

Now I have sent proof of Sidney so lets see if that disappears also.

International Wargraves Photography Project statement

RECENTLY we have discovered a great number of images uploaded to our Memorial pages

which were lifted from other web sites in violation of copyright laws.

These will be reported to FindAGrave and the Contributor in question IMMEDIATELY when discovered.

Obviously not the same rules for FIND A GRAVE.

No apology to myself, just a curt e-mail.

Sidney has now been removed.

Still worried about putting anything into the public domain now.

Unfortunately Sandy, you've found out the hard way that people do copy, and try to pass off as their own, photos and work by others. All you can do, if you don't want your work freely available to all, is to do as you have already done and watermark it all. That, or just not put it in the public domain.

In a perfect world we'd be able to trust people, eh?

I think there is some confusion between "public domain" and "in the public domain"; in the former the copyright holder has given it up or there is no existing copyright, the latter simply means it is available to the public but someone holds the copyright. In the latter case the holder can enforce it in the normal manner.

As a caveat to Pighills's comment, putting a watermark on it doesn't give you copyright, it only is a claim to the copyright which you have in this case. I have seen copyright watermarks applied by people who patently do not have copyright of the image concerned.

Hubby says not to give up so I guess I will have to copyright all the pictures etc I may put on

a web site.

Not sure what is the "normal manner", I am a bit thick about copyright law.

I do not object to them being on the www, just that someone else is accredited with them.

So am I! And I'm a bit sketchy on IP law in general. If they won't take the photo down or credit you with it then your recourse is probably via the courts. There is a widespread belief that copyright (and legislation in general) don't apply on the internet so this is sometimes done in ignorance rather than malice. On Tumblr for example it seems to be common for posters to state they don't have copyright and if you object to their use then to tell them and they'll take it down, which is exactly the wrong presumption.

I am a contributor to Find A Grave, and the quote above referencing International Wargraves Photography Project was from my bio page. As for any photos one finds on FindAGrave please email me at thefallen.remembered@gmail.com with a link to the page and a brief note as to the circumstances, and I will send it on to an Administrator I work closely with and have it removed ASAP.
